1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the BullBear AI website, web application, reports, podcasts, and related services (the "Service"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. What the Service is

BullBear AI generates automated, AI-assisted market research: structured bull-case and bear-case reports, quantitative metrics, citations to third-party sources, and audio summaries, based on topics you submit. The Service aggregates and processes publicly available information and market data; it does not provide brokerage, custody, or order execution of any kind.

3. Not financial advice

The Service produces automated informational content only. Nothing in the Service constitutes financial, investment, legal, accounting, or tax advice, an offer or solicitation to buy or sell any security or other instrument, or a recommendation of any investment strategy. AI-generated output can be incomplete, outdated, or wrong. You are solely responsible for your investment decisions, and you should consult a licensed professional before acting on anything you read or hear in the Service. MOIQ Digital Limited is not a licensed investment adviser, broker, or dealer in any jurisdiction.

4. Accounts

You must be at least 18 years old to use the Service. You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it up to date. We may suspend or terminate accounts that violate these Terms.

5. Plans, billing, and cancellation

The Service offers a free tier with usage limits and paid subscriptions billed in advance on a recurring basis. Payments are processed by Stripe; we do not store your full card details. Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings, and cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable; if you believe you were charged in error, contact us within 14 days and we will review in good faith.

We may change prices or plan limits with reasonable prior notice; changes apply from your next billing period.

6. Fair use

Usage quotas (analyses, podcasts, watchlist items) exist to keep the Service available for everyone. Circumventing quotas, scraping the Service, reselling output as an automated data feed, or using the Service to build a competing automated product is not permitted without our written consent.

7. Acceptable use

You agree not to: (a) use the Service for unlawful purposes, including market manipulation or the distribution of misleading financial information presented as fact; (b) attempt to gain unauthorized access to the Service or its infrastructure; (c) interfere with the operation of the Service; (d) remove or obscure disclaimers, citations, or attributions in shared reports.

8. Content and intellectual property

The Service, including its software, design, models, prompts, and branding, is owned by MOIQ Digital Limited or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use reports and podcasts generated for you for your own informational purposes, including sharing via the built-in share links. You retain ownership of the topics and inputs you submit, and you grant us a licence to process them to operate and improve the Service.

Reports may include excerpts from and links to third-party sources; those materials belong to their respective owners and are provided for attribution and verification.

9. Availability and changes

The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features at any time. We do not warrant that the Service will be uninterrupted, error-free, or that data (including market data) will be accurate or current.

10. Limitation of liability

To the maximum extent permitted by law, MOIQ Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or investment losses, arising out of or related to your use of the Service. Our aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim and (b) USD 100.

11. Indemnity

You agree to indemnify and hold harmless MOIQ Digital Limited from claims arising out of your misuse of the Service or violation of these Terms.

12. Termination

You may stop using the Service at any time and may request deletion of your account. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive termination (including 3, 8, 10, 11, 13) survive.

13. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong shall have exclusive jurisdiction, without prejudice to mandatory consumer protections of your place of residence.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the Service or by email. Continued use after changes take effect constitutes acceptance.
